This website is operated by EVCON Spółka z ograniczoną odpowiedzialnością with its registered office at Al. Pokoju 18D, 31-564 Kraków, Poland, entered in the register of entrepreneurs of the National Court Register (KRS) under number 0000988565, NIP 676-262-40-44, REGON 522901992, share capital: PLN 5,000 (“EVCON”, “we”, “us”).

2. Scope of These Terms

These Terms of Service govern the use of the EVCON website and the free electronic services available through it. They also constitute the terms of providing services by electronic means (regulamin świadczenia usług drogą elektroniczną) within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.

3. Electronic Services

Through this website we provide, free of charge:

  • access to informational content about EVCON and its services,
  • a contact form for submitting enquiries,
  • an email newsletter, available on subscription.

The newsletter subscription starts when you submit your email address via the sign-up form and is concluded for an indefinite period. You may terminate it at any time, free of charge, by using the unsubscribe link included in every newsletter email or by contacting us.

4. Technical Requirements

Using the website requires a device with internet access, a current version of a modern web browser with JavaScript enabled, and — for the contact form and newsletter — an active email account.

5. Prohibited Use

You may not use the website in a manner that disrupts its operation or submit unlawful content through it, including content that infringes third-party rights.

6. Intellectual Property

The content of this website — including texts, graphics, logos, case studies, and layout — is owned by EVCON or its licensors and is protected by copyright and other intellectual property laws. You may browse the website and use its content for your own informational purposes. Reproducing, distributing, or using website content for commercial purposes requires our prior written consent. Third-party names and trademarks appearing on the website belong to their respective owners.

7. Third-Party Links and Services

The website contains links to external services (e.g. Calendly, LinkedIn, justjoin.it, Mailchimp). These services are operated by third parties under their own terms and privacy policies, and we are not responsible for their content or operation.

8. Services and Engagements

Descriptions of consulting and engineering services on this website are for general information only and do not constitute an offer within the meaning of the Polish Civil Code. Specific engagements are governed by separate written agreements between EVCON and the client.

9. Liability

We make reasonable efforts to keep the information on this website accurate and the website available, but the website is provided “as is”. To the extent permitted by applicable law, EVCON is not liable for damage arising from the use of, or inability to use, this website or from reliance on its informational content. Nothing in these terms excludes liability that cannot be excluded under applicable law, including liability for wilful misconduct, or limits any mandatory statutory rights of consumers.

10. Complaints

Complaints regarding the operation of the website or the electronic services can be submitted to enquiries@evcon.pl. A complaint should include your contact details and a description of the issue. We will respond within 14 days of receiving the complaint. Consumers may also use out-of-court complaint and redress procedures, for example before the permanent consumer arbitration courts at the Trade Inspection; information is available at uokik.gov.pl.

Information on how we process personal data, including in connection with the contact form and the newsletter, is provided in our Privacy Policy.

12. Changes to These Terms

We may amend these terms for valid reasons, such as changes in law or in the services provided through the website. The current version, with its last-updated date, is always available on this page. Amendments do not affect enquiries submitted or engagements concluded before the change.

13. Governing Law and Disputes

These terms are governed by Polish law. Any disputes will be resolved by the Polish common courts competent for the registered office of EVCON, except where mandatory provisions of law — in particular those protecting consumers — provide otherwise.

14. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
